Wife can donate kidney to her husband even if her family members do not consent
Where proposed organ transplant is between a married couple out of pure love and affection, with no element of greed involved, non-consent of family members of either spouse for organ transplant, cannot become a hurdle.
Husband of proposed donor had a kidney problem and his medical treatment was underway for last one year. Proposed donor being legally wedded wife expressed desire to donate her kidney to her husband. Recommendation of transplant of kidney made subsequent to Doctors declaring mother of recipient as incompetent donor.
As per inquiry report, there was no material to indicate any malpractice or element of greed or any kind of pressure on proposed donor to donate her kidney to husband. Such donation of kidney was out of pure love and affection, with no element of greed involved. In such case necessary approval cannot be denied on account of mere suspicion.
Merely because the parents or sibling of proposed donor have not come forward to give consent for transplant of the organ, is not a ground to reject such donation. Especially when identity and consent of the donor have been verified by a Senior Superintendent of Police.
