The accused had assaulted a minor victim aged 9 only years, with a school bag in his school premises, after insulting him in filthy language. The minor victim and his mother had narrated in detail about the incident. Minor victim had also identified the accused and showed mark of injury on his body. As per the injury report, the victim was hit on his left ear and on his back with a school bag. There was no ambiguity or inconsistency in evidence of the minor victim. Charges levelled against the accused were proved. The Bombay High Court upheld the conviction of accused for assaulting the minor victim.
