If an employee is working on a temporary basis, he is required to complete 10 years of his service as on stipulated date in Government Order, so as to be entitled to the benefit of such Order, which provides for regularization of persons working on full time basis as daily wage employees and expressly excludes persons working on part time basis or as casual employees. No Government Order enables regularization from the initial date of appointment.

In this case the employee was appointed as a Sweeper on temporary basis as a contingent worker which was not a sanctioned post. The Government Order was issued with a retrospective effect providing regularization of persons working on full time basis as daily wage employees and expressly excludes persons working on part time basis or as casual employees. Employees like Sweeper in this case are required to complete 10 years of service so as to be entitled to the benefit of Government Order As there were no sanctioned posts and appointment of employee was on a contingent and temporary basis, he is not entitled to regularization from date of initial appointment. Since there were no sanctioned posts and appointment of employee was on contingent and temporary basis, employee cannot be held entitled to regularization from date of initial appointment.
