Short term permit can be granted for mineral lease for a maximum period of six months by e-tender/e-auction
Lessee seeking grant of 5 years of mining lease challenged that amendment in Rule 23(2)(a) of Uttar Pradesh Minor Minerals (Concession) Rules, which facilitates short term mining permit by way of e-tender-cum-e-auction.
Amendment introduced in the exercise of powers under S. 15(1) of Mines and Minerals (Regulation and Development) Act, 1957 and is in the domain of statute regulating the grant of mining permit as it is not possible to settle the river bed mining areas for the long term, as such areas can be settled through the short term mining permit not exceeding 6 months by e-tender/e-auction.
Lessee thus failed to prove that such amendment is violating statutory mandate. Short term permit can be granted for mineral lease for a maximum period of 6 months by e-tender/e-auction.
