Once the entire issue is settled and decided by National Green Tribunal, High Court cannot sit as Appellate Court over its judgement

In instant case, the appellant, industrial unit aggrieved by order of Uttarakhand State Pollution Control Board. Said board imposed an environmental compensation to the tune of Rs. 37,31,250/- upon the industrial unit.


In respect of issues regarding pollution being allegedly caused by industrial units and payment of environmental compensation by said units to the State Pollution Control Board, directions issued by National Green Tribunal (NGT). On basis of said directions of NGT, an environmental compensation of Rs. 37,31,250/- imposed upon the appellant.


Once the entire issue is settled and decided by NGT, the High Court does not have the power to sit as appellate Court over a judgment passed by NGT. Appellant having sufficient alternate remedy of filing review petition or filing appeal before Supreme Court.


Special appeal filed by the appellant against an order imposing environmental compensation, liable to be dismissed.
