Motor Accident Claims Tribunal is duty-bound to decide each and every issue, after points of determination have already been framed by it

Motor Accident Claims Tribunal rejected the claim petition without considering all the issues framed by it before reaching the conclusion and rejecting the claim petition.


Rejection of claim petition mainly on the ground that claimant being a police officer lodged the FIR after eight days of the incident.


Court held that, although indeed, the Motor Accident Claims Tribunal is not required to strictly adhere to the provisions of the Civil Procedure Code, when points of determination have already been framed by the Tribunal itself, then it was the duty of the Tribunal to decide every issue before deciding the claim petition finally.
