The Vehicle involved in the accident was a goods carrier that was supposed to be used only for an agricultural purpose. At the time of accident however, the vehicle was not used for any agricultural purpose and the claimant was not supposed to travel in that vehicle. There was no seating capacity for any passenger in the goods carrier and if claimant suffered disability due to travelling illegally in that vehicle, the insurance company cannot be held liable to pay compensation. The Madras High Court held the owner of vehicle liable to pay compensation.
