Candidates completing PG through Open University without obtaining basic Graduation Degree is not eligible for appointment in public services

A person gets no vested right to be appointed unless order of appointment is issued. Candidates completing Post Graduation through Open University without obtaining basic Graduation Degree is not eligible for appointment in public services.

The petitioner applied for Group-I post in public services on basis of M.A Degree obtained through Open University System without completing B.Com. But selection of petitioner was withheld for clarification from Tamil Nadu Public Service Commission and not culminated in issuance of appointment order.

Therefore, G.O.Ms.No.116, D/- 18.08.2010, providing that candidates completing Post Graduation through Open University without obtaining basic Degree, cannot be considered as possessing Post Graduate Degree for appointment in public services, though issued after issuance of recruitment notification, would be applicable to case of petitioner. When the petitioner became qualified to be short listed for oral test on the basis of his ranking in main written examination, he was put on notice that his admission to the oral test commencing from 4th December 2009 is purely provisional. Selection of petitioner was rightly withheld for clarification from Tamil Nadu Public Service Commission and could not be culminated in issuance of appointment order.
