While the employee claimed to be working as General Manager for Hydro Electric Project of State, the State denied employer-employee relationship with her on the ground that employee worked in co-operative store and drew salary therefrom. The witnesses has admitted that the State Authorities had placed some of its employees in the co-operative store. Appointment letter issued by Manager of Power Plant clearly mentioned that employee was employed on compassionate grounds. Denial of employer-employee relationship by State Authorities was improper. The Jammu and Kashmir High Court held General Manager is to be treated as employee of State and entitled to payment of salary.
